Resolution #11-01-2023 for Levy Limit Increase
Resolution Number 11-01-2023
Whereas, the State of Wisconsin has imposed levy limits on towns, villages, cities and county levies for 2023 and thereafter under Wis. Stat. 66.0602;
Whereas, Wis. Stat. 66.0602 limits the allowable local levy for 2023 to a percentage increase of no more than the greater of (a) zero percent of the 2023 (payable 2024) adjusted actual levy as calculated under the state’s levy limit law or (b) a percentage equal to the percent change in equalized value due to net new construction less improvements removed, which for the Town of Whitewater is 0.328%;
Whereas, the Town Board of the Town of Whitewater, Walworth County, believes that for the 2023 tax levy (to be collected in 2024), it is in the town’s best interest to exceed the state levy limit as described above by a greater percentage than 0.328%.
Whereas, the Town of Whitewater’s 2023 (payable 2024) adjusted actual tax levy was $478,005.00 and further whereas the state law would limit this year’s increase to $1567.86 ($478,005.00 x 0.328%) for a total allowable town tax levy of $479,217.00 ($479,573.00 less $355.74 for the 2024 personal property aid payment) after adjustments for 2023 (to be collected in 2024);
THEREFORE, the Town Board of the Town of Whitewater, Walworth County does hereby resolve and order as follow:
- The Town Board supports an increase in the town tax levy for 2023 that will exceed the State limit and result in an increase of $100,000.00.
- The town board directs that the question of increasing the allowable town tax levy for 2023 (to be collected in 2024) by 20.867%, ($100,000.00 divided by $479,217.00) which would increase the town levy by $100,000.00, for a total tax levy (after adjustments) of $579,217.00 ($100,000.00 + $479,217.00), shall be placed on the agenda for the Electors’ Special Town Meeting to be held on November 16, 2023.
